These Terms and Conditions (“Terms”) govern access to and use of the Klyne application and related services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Klyne” refers to Klyne NEDA LLC, a Delaware limited liability company. “Service” refers to the Klyne mobile application, website, APIs, and any related services provided by Klyne. “User” refers to any individual who accesses or uses the Service. “NEDA” refers to the Newtonian Emotional Dynamics Algorithm, a proprietary, rule-based computational framework owned by Klyne. “Content” refers to all text, summaries, outputs, insights, labels, visualisations, and materials made available through the Service. “User Data” refers to any data provided, logged, or generated through a User’s interaction with the Service.

2. Scope, Nature, and Privacy Commitment

Klyne is a private, individual-use digital reflection and personal insight application. The Service enables Users to log self-selected emotional and contextual information and view structured summaries intended to support personal awareness and reflection.

The Service is informational in nature. It relies on User-provided inputs and applies a combination of rule-based logic and AI-assisted language rendering to organise and display patterns within those inputs.

Klyne’s privacy commitment: Klyne does not sell User data, does not show advertisements, does not share User data with advertising networks, and does not provide employers, organisations, or any third party with access to individual User data. These are permanent structural commitments, not policies subject to change for commercial reasons.

The Service does not monitor Users outside the application, does not observe workplace activity, and does not generate evaluations or judgments about Users as individuals.

The Service is not a medical device, clinical system, diagnostic tool, therapeutic service, or substitute for professional advice of any kind.

3. Eligibility and Access

The minimum age to use the Service is sixteen (16) years where no higher local requirement applies. In jurisdictions where a higher minimum age applies to digital services or health-adjacent applications, that higher age governs. Users are responsible for confirming they meet the applicable minimum age requirement in their jurisdiction.

The Service is intended for personal, individual use only. It is not an employer tool, workplace monitoring system, or organisational analytics platform.

Klyne reserves the right to suspend, restrict, or terminate access to the Service at any time where use presents legal, technical, ethical, or operational risk.

4. No Medical, Psychological, or Professional Advice

All Content provided through the Service is for informational and self-reflection purposes only.

Klyne and NEDA do not diagnose, treat, cure, prevent, or assess any medical, psychological, or mental health condition.

The Service is not a crisis or emergency tool. Users experiencing a risk of harm to themselves or others are encouraged to contact emergency services or appropriate professional support. The Service must not be relied upon in any situation requiring immediate professional or emergency response.

5. Algorithms, Automation, and AI-Assisted Content

Klyne uses a two-layer system to generate the outputs displayed to Users.

The first layer is NEDA, which applies predefined rules, thresholds, and calculations to User-selected inputs, including frequency, intensity, and persistence of logged entries. All escalation classifications — Mild, Moderate, and Urgent — are generated by NEDA using fixed, deterministic logic applied to logged data only. These labels reflect data patterns, not health status or risk assessments.

The second layer uses OpenAI’s API to phrase those pre-computed NEDA outputs into readable language. To produce responses that reflect a User’s recent emotional patterns, a limited window of that User’s own recent log entries is included alongside the NEDA outputs in the request sent to OpenAI. Specifically, emotion labels, scenario tags, and timestamps from the preceding 7 days are transmitted alongside a structured prompt. No generated insights, escalation classifications, or NEDA-computed outputs are transmitted to OpenAI. No data from other Users is ever included. The Service does not include a free-text notes feature, so no free-text content is transmitted to OpenAI.

OpenAI does not determine escalation levels, generate independent assessments of Users, or use data submitted via Klyne’s API to train its models, based on OpenAI’s published API data usage policies.

The Service does not perform automated decision-making producing legal or similarly significant effects.

6. User Conduct and Acceptable Use

You agree not to misuse the Service, including by attempting to surveil, profile, or monitor other individuals using the Service; reverse engineering, replicating, or simulating NEDA or any Klyne proprietary system; using outputs for unauthorised commercial purposes; submitting unlawful, misleading, or harmful content; interfering with the operation, security, or integrity of the Service; or extracting Klyne-generated insights or content for external AI training or commercial redistribution without prior written consent.

7. Intellectual Property

All rights, title, and interest in and to the Service, including software, algorithms, designs, logic, NEDA, and Content, remain the exclusive property of Klyne or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for its intended personal, individual purposes.

8. Subscriptions and Payments

Klyne offers free and paid subscription tiers. Billing, renewal, cancellation, and refunds are governed by the terms of the applicable purchase channel and applicable law. Klyne does not store or process full payment card details.

9. Data and Privacy

Use of the Service is subject to the Klyne Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference.

10. Availability and Modifications

Klyne may modify, suspend, or discontinue any part of the Service at any time. No guarantee is made regarding availability, continuity, or outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, Klyne shall not be liable for any indirect, incidental, consequential, special, or non-material damages arising from or related to use of the Service.

Where liability cannot be excluded, Klyne’s total aggregate liability shall not exceed the fees paid by the User in the twelve (12) months preceding the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable mandatory consumer protection law in your jurisdiction.

12. Indemnification

You agree to indemnify and hold harmless Klyne from any claims, damages, losses, or expenses arising from your misuse of the Service or violation of these Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Mandatory consumer protection rights applicable in your jurisdiction remain unaffected and take precedence where required by local law.

14. Changes to These Terms

Klyne may update these Terms from time to time. Material changes will be communicated through the Service or other appropriate means prior to taking effect. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
